Tak Cegah Genosida di Gaza, Warga Palestina Gugat Biden

TVN24 Online — Presiden AS Joe Biden digugat oleh sekelompok warga Palestina di Amerika Serikat karena dinilai tidak bisa mencegah genosida di Gaza.

Pada Senin (13/11), sekelompok warga Palestina yang juga terdiri dari organisasi hak asasi manusia (HAM), Al-Haq dan Defense for Children International, mengajukan gugatan yang meminta Washington bisa memenuhi kewajibannya di bawah hukum internasional.

Hal tersebut dilakukan untuk mencegah genosida pada warga Palestina yang kini tengah dilancarkan Negeri Zionis.

“Genosida yang sedang berlangsung terhadap warga Palestina di Gaza sejauh ini dimungkinkan karena dukungan tanpa syarat yang diberikan oleh Presiden Joseph Biden, Menteri Luar Negeri Antony Blinken, dan Menteri Pertahanan Lloyd Austin, merupakan pelanggaran tanggung jawab AS di bawah hukum humaniter internasional, sebagaimana diatur dalam Konvensi tentang Pencegahan dan Penghukuman Kejahatan Genosida,” sebagaimana bunyi gugatan tersebut, dikutip Middle East Eye, Selasa (14/11).

Semenjak konflik Hamas vs Israel terjadi pada 7 Oktober lalu, banyak pihak yang sudah mengigatkan bahwa Negeri Zionis berpotensi melakukan genosida di Palestina.

Sebagai informasi, Genosida sendiri merupakan tindakan yang dilakukan dengan maksud menghancurkan, secara keseluruhan atau sebagian, sebuah kelompok nasional, etnis, ras, maupun agama. Ini merujuk pada Pasal II Konvensi Genosida PBB dan Statuta Roma Pengadilan Pidana Internasional (ICC).

Dari pertimbangan inilah kelompok warga Palestina kemudian mengajukan gugatan hukum pada Biden, Blinken, dan Austin di Pengadilan Distrik untuk California Utara. Di mana pengadilan ini memiliki yurisdiksi untuk masalah tersebut.

Gugatan ini diketahui diajukan oleh warga Palestina bersama Pusat Hak Konstitusional (Center for Constitutional Rights/CCR) dan firma hukum, Van Der Hout, LLP.

Para penggugat menilai, gugatan ini sama dengan upaya terakhir untuk menghentikan pembunuhan massal di Gaza, dan menghentikan AS mendukung dan memasok bantuan lebih lanjut ke Israel.

Sejauh ini, AS ini tercatat sudah mengirimkan bantuan tambahan 14 miliar dolar atau setara Rp219 triliun ke Israel. Jumlah tersebut di samping 4 miliar dolar (Rp62,8 triliun) bantuan tahunan yang diberikan Washington pada  Tel Aviv.

Bahkan, AS sudah menyetujui penjualan smart-guided bomb senilai 320 juta dolar (Rp5 triliun) ke Israel.

“Selama lima minggu terakhir, Presiden Biden dan Menlu Blinken dan Austin telah berdiri bahu-membahu dengan pemerintah Israel yang telah memperjelas niatnya menghancurkan penduduk Palestina di Gaza,” ujar Katherine Gallagher, pengacara senior di CCR yang juga salah satu pengacara yang membawa kasus ini.

“AS punya kewajiban yang jelas dan mengikat untuk mencegah, bukan malah lebih jauh membiarkan genosida. Mereka telah gagal dalam memenuhi kewajiban hukum dan moral untuk menggunakan kekuatan mereka yang cukup besar guna mengakhiri kengerian ini,” imbuhnya.

Sementara itu, Kementerian Pertahanan AS sendiri tidak berkomentar terkait hal ini. Gedung Putih dan Kementerian Luar negeri juga tidak segera menanggapi permintaan Middle East Eye untuk berkomentar.

Sejauh ini, agresi Israel di Gaza sudah menewaskan lebih dari 11.200 warga Palestina, dengan sebagian besar anak-anak dan perempuan.

Semakin hari, kondisi Gaza semakin mengkhawatirkan, sebab Negeri Zionis kini mengintensifkan serangan di rumah sakit-rumah sakit.

Bukan hanya itu, para warga sipil dikepung dari segala penjuru. Bahkan, Israel dengan keji menembak siapapun dan apapun benda yang bergerak.
